Terms of Use & Service Agreement
Effective Date: September 13th, 2024
This Terms of Use and Service Agreement ("Agreement") is entered into between FireUp Soccer LLC ("FireUp Soccer," "we," "us," or "our") and the participant or their legal guardian ("you" or "Client"). By registering for any program offered by FireUp Soccer LLC, you agree to be bound by the terms and conditions set forth below.
1. Services
FireUp Soccer LLC provides youth and player soccer training programs, including but not limited to group classes, individual sessions, and special training events. The specific program, schedule, and session details will be outlined at the time of registration.
2. Registration and Enrollment
Enrollment is confirmed upon completion of the registration form and receipt of initial payment. A registration spot is not guaranteed until both steps are complete. By completing registration, you agree to all terms in this Agreement, as well as the Player Waiver and Privacy Policy.
3. Recurring Payments and Billing
By enrolling in a recurring program, you authorize FireUp Soccer LLC to automatically charge your payment method on file for all applicable fees, according to the billing schedule associated with your selected program.
- Charges will be processed on scheduled due dates using the payment method provided at registration.
- It is your responsibility to keep your payment information current. Please notify us promptly of any changes to your billing details.
- This authorization remains in effect for the duration of enrollment and continues on a recurring basis until proper written cancellation is submitted and confirmed.
- Non-attendance does not constitute cancellation and does not relieve you of payment obligations.
4. Additional Sessions and Invoicing
If your child attends sessions beyond those included in your current enrollment or pass, FireUp Soccer LLC reserves the right to invoice you separately for those additional sessions. Invoices will be sent to the email address on file and are due within 7 days of the invoice date unless otherwise arranged in writing. Continued participation in additional sessions constitutes acceptance of the applicable fees.
5. Cancellation Policy
To cancel enrollment and stop recurring charges, you must provide at least two (2) weeks written notice prior to the next scheduled billing date. Cancellation requests must be submitted by email to contact@fireup-soccer.com. Verbal requests or text messages are not accepted as valid cancellation notice.
Failure to provide timely written notice will result in the next scheduled payment being processed. You remain financially responsible for all charges until proper cancellation has been confirmed in writing by FireUp Soccer LLC.
6. Makeup Class Policy
If your child misses a scheduled class, you have one calendar month from the date of the missed class to schedule a makeup session. To request a makeup, simply reach out and let us know which day works for you, and we will confirm based on availability.
- One (1) makeup class is available per missed session, subject to availability.
- Makeup sessions must be scheduled in advance and completed within one calendar month of the missed class.
- Makeup classes do not roll over and cannot be rescheduled once forfeited.
- No refunds, credits, or prorations will be issued for missed classes beyond the one allotted makeup.
7. Schedule Changes
If you ever need to switch to a different training day on an ongoing basis, please reach out directly by phone or text at (346) 462-1042, or by email at contact@fireup-soccer.com, and we will do our best to accommodate you. Schedule changes are subject to availability in your preferred session.
8. Refund Policy
All payments are non-refundable unless FireUp Soccer LLC cancels a session without rescheduling. In the event of a cancellation by FireUp Soccer LLC, a makeup session or credit toward a future class will be offered.
9. Code of Conduct
All participants and accompanying adults are expected to conduct themselves respectfully toward coaches, other players, and parents at all times. FireUp Soccer LLC reserves the right to dismiss any participant whose behavior is deemed disruptive or harmful, without obligation to issue a refund.
10. Limitation of Liability
FireUp Soccer LLC's total liability for any claim arising from or related to this Agreement shall not exceed the total amount paid by the Client for the current enrollment period. FireUp Soccer LLC is not liable for indirect, incidental, or consequential damages of any kind.
11. Modifications to Terms
FireUp Soccer LLC reserves the right to update these Terms at any time. Updated terms will be posted on our website at www.fireup-soccer.com and, where material changes occur, communicated to Clients by email. Continued enrollment following notice of changes constitutes acceptance of the updated Terms.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this Agreement shall be resolved in the courts of Harris County, Texas.

Acknowledgment and Agreement
By completing registration with FireUp Soccer LLC, you confirm that you have read, understood, and agree to all terms and conditions set forth in this Agreement. You further acknowledge that your electronic signature on the registration form carries the same legal effect as a handwritten signature and constitutes your acceptance of this Agreement in full.
Player Waiver

Assumption of Risk
By participating in any activities or services provided by FireUp Soccer LLC, the participant (or their legal guardian) acknowledges and voluntarily assumes all risks associated with athletic participation. These risks include, but are not limited to, physical injury, falls, contact with other participants, equipment-related injuries, property damage, and other unforeseen circumstances that may arise during or as a result of participation.
Liability Waiver and Release Agreement
To the fullest extent permitted under applicable law, the participant (or their legal guardian) agrees to release, indemnify, and hold harmless FireUp Soccer LLC, its owners, employees, coaches, agents, and affiliates from any and all claims, demands, damages, or causes of action arising out of or related to the participant's involvement in FireUp Soccer LLC's activities or services, including those caused by ordinary negligence.
The participant further acknowledges and agrees that their information may be stored and used by FireUp Soccer LLC for administrative, communication, and promotional purposes related to its programs.
Media Release Consent
The participant (or their legal guardian) grants FireUp Soccer LLC permission to use photographs, videos, or any other media captured during activities for promotional and marketing purposes, including but not limited to the website, social media, and printed materials, without compensation or further notice.
Health and Fitness Acknowledgment
The participant (or their legal guardian) acknowledges that FireUp Soccer LLC is not responsible for injuries, accidents, or damages that may occur during training sessions, events, or related activities. It is the participant's responsibility to maintain appropriate health, fitness, and skill levels for the activities in which they participate.
Code of Conduct
The participant (or their legal guardian) agrees to comply with all rules, guidelines, and instructions provided by FireUp Soccer LLC during activities. Failure to comply may result in removal from activities without entitlement to a refund.
Binding Agreement
This liability clause is binding upon the participant, their heirs, representatives, successors, and assigns. It represents the entire agreement between the participant and FireUp Soccer LLC, superseding any prior discussions or agreements, whether oral or written. If any portion of this agreement is held invalid, the remaining provisions shall continue in full legal force and effect.
Electronic Signature
By checking the registration box, the participant (or their legal guardian) confirms they have read, understood, and voluntarily agree to the terms stated in this waiver, including the media release consent. The electronic signature delivered via the registration form carries the same legal effect as an original manual signature.
